• Shannon H. Hedvat works on intellectual property matters, in particular patent and trademark litigation across numerous technology sectors, including internet architecture, computer security, software, satellite radio devices and service, devices used in the semiconductor industry, microcontrollers, and LEDs. Shannon has assisted in the defense and enforcement of clients’ rights at every stage of litigation, playing a key role on trial teams, taking and defending depositions, drafting trial and appellate briefs, and preparing expert witnesses for depositions as well as direct and cross examinations at trial. Shannon also has an active post-grant practice including representing and defending clients before the Patent Trial and Appeal Board.  

    Shannon also assists in transactions involving intellectual property assets, particularly in the context of mergers and acquisitions, as well as the negotiation and drafting of technology license and services agreements. She provides support in enforcement matters relating to trademark and copyright protection, in particular in the fashion, media, financial services and telecommunications industries. Her background is in systems science and engineering, with a focus on product development and design and the optimization of embedded systems.

    Shannon dedicates significant time to pro bono and civic work. She has drafted and negotiated consulting, services and licensing agreements for nonprofit organizations, and she has represented pro bono clients both in the New York Appellate Division, First Department and the New York Court of Appeals. Shannon also serves on the board of governors of Newark Academy in New Jersey and holds an emeritus position on the executive board for the Penn Fund at the University of Pennsylvania. She also serves as the regional coordinator for the annual Northeast Regional Jessup Moot Court Competition in New York City.

    Shannon is co-chair of Kramer Levin’s Next Generation Collaboration Committee and is a member of the firm’s Women’s Initiative Committee.

    Experience

    • Defending Sirius XM Radio Inc. in a patent infringement lawsuit brought by Fraunhofer-Gesellschaft zur Förderung der Angewandten Forschung e.V., a Germany-based research organization, involving the licensing and sublicensing of satellite communication networks.

    • Defended Sirius XM Radio Inc. against right of publicity claims by a former on-air personality based on the alleged use of excerpts from his appearances on archival episodes of “The Howard Stern Show” in online and on-air advertisements, securing a ruling dismissing the claims as preempted by the Copyright Act and successfully defending that ruling on appeal to the U.S. Court of Appeals for the Second Circuit.

    • Defended Sirius XM Radio Inc. against a patent infringement suit brought by Dragon Intellectual Property LLC against Sirius XM Radio and nine other defendants, securing dismissal of the suit and an order from the U.S. District Court for the District of Delaware that the scope of the patent claims could not encompass the audiovisual recording and playback technology based on representations made during the prosecution of the asserted patent. The dismissal later included the awarding of attorneys’ fees and costs.

    • Represented Sirius XM Radio Inc. in a petition for an inter partes review of a Dragon Intellectual Property LLC patent for audiovisual recording and playback technology before the PTAB, securing a decision holding that all asserted claims of the patent were unpatentable and affirmed by the U.S. Court of Appeals for the Federal Circuit.

    • Represented Sirius XM Radio Inc. in its acquisition of Agero Connected Vehicle Telematics Services.

    • Successfully represented Sirius XM Radio Inc. in a patent infringement suit regarding certain technology related to satellite communication networks.
