• Claudia Pak is a skilled civil litigator and counselor with a diverse practice representing clients, including Fortune 500 companies, in complex commercial litigation in both state and federal courts. She has vast experience representing clients in advertising, antitrust, business torts and securities litigation and has extensive appellate experience.

    Claudia’s work involves all phases of litigation, including drafting pleadings, managing discovery and drafting discovery motions, drafting trial and appellate briefs, drafting jury instructions, taking and defending depositions, and enforcing and defending the enforcement of judgments. She has participated in multiple trial teams and assisted with all aspects of trial preparation.

    Claudia was part of a team that successfully defeated a foreign sovereign’s attempt to resist subject matter jurisdiction in the United States — an issue that was litigated from the federal district court to the U.S. Supreme Court. She helped obtain a multimillion-dollar jury trial victory in a trade secret and unfair competition case in federal court, and she assisted in representing a class of consumer packaged goods companies in an antitrust litigation matter against News Corporation that led to a $250 million settlement. Claudia also assisted in the representation of an outside auditor in a trade secret and breach of contract lawsuit, which resulted in a complete dismissal of the case. Her other notable work includes assisting in the defeat of a billion-dollar judgment against a major Korean corporation in an enforcement effort in New York and assisting in the defense of a Canadian company in a breach of contract lawsuit.

    Claudia dedicates significant time to pro bono matters. She has provided legal assistance to numerous low-income clients, including children, on a pro bono basis in connection with asylum, special immigrant juvenile status, U visa and deferred action for childhood arrivals applications. Claudia was instrumental in obtaining visas for two children in Ecuador and their mother in the United States, reuniting the family after years of living apart. In addition, Claudia represented a Holocaust survivor in an effort to obtain pension payments and back payments from the German government resulting from the client’s work in a Nazi-controlled ghetto during World War II.

    As a member of Kramer Levin’s Diversity Committee, Claudia aims to raise awareness about diversity, inclusion and multiculturalism in the workplace. She is also a member of the firm’s Attorneys of Color Affinity Group. New York Super Lawyers recognized Claudia as a Rising Star (2017 – 2022).

    Experience

    • Represents EIG Global Energy Partners in a $221 million fraud action against Petrobras SA, the Brazilian state-owned oil company.

    • Obtained, as a member of the litigation team, a $250 million settlement in an antitrust class action of consumer packaged goods companies against News Corporation and affiliated co-defendants alleging that News Corporation monopolized the third-party in-store promotions market.

    • Obtained, as a member of the trial team, a multimillion-dollar jury trial victory for TydenBrooks in a trade secret and unfair competition case in federal court against a competitor regarding manufacturing processes.

    • Obtained, as a member of the trial team, a bench trial victory in federal court on behalf of a major foreign industrial company, defeating an effort by DuPont to enforce a $920 million judgment in New York.

    • Obtained, as a member of the litigation team, a dismissal with prejudice in federal court on behalf of KPMG Canada and KPMG US on trade secret, copyright and tortious interference with contract claims.

    • Successfully represented EIG Global Energy Partners in a contractual dispute against, among others, the Province of Ontario, Canada, relating to a power plant project in Ontario.

    • Represented Johnson & Johnson Consumer Inc., as a member of the litigation team, in a challenge before the National Advertising Division against certain advertising by Chattem Inc. for a competing product. NAD recommended that Chattem discontinue and/or modify its claims regarding that product.
