The FTC has filed a complaint against marketer Marc Ching, who began to market a dietary supplement called “Thrive” as an “anti viral wellness booster” beginning on or around March of 2020. In response to the complaint, Ching, who does business as Whole Leaf Organics, agreed to a preliminary order barring him from making unsupported claims that Whole Leaf’s Thrive supplements are effective at treating, preventing and reducing the risk of contracting COVID-19. The order also bars Whole Leaf from making false or deceptive claims that its CBD-EX, CBD-RX, and CBD-Max cannabidiol products are effective cancer treatments. The FTC also approved the issuance of an administrative complaint, which seeks an order permanently halting Ching’s allegedly deceptive advertising for the Thrive and CBD-EX, CBD-RX, and CBD-Max products. The administrative case is set to begin on January 7, 2021.
