Kramer Levin secured a victory against the NYC Department of Education (DOE) on behalf of a disabled student diagnosed with severe autism and intellectual disability, who suffers from cognitive, emotional, physical and behavioral deficits. Kramer Levin assisted the parent with obtaining an independent neuropsychological evaluation for the student, and subsequently filed a Due Process Complaint against the DOE. Following a one day trial in which Kramer Levin put forth three witnesses, Kramer Levin received a 17-page decision ordering the full relief requested. Specifically, Kramer Levin secured an order finding that the DOE had failed to provide the student with a free and appropriate public education as required by federal law; requiring the DOE to fund specialized behavioral and educational services from an independent provider across the student’s entire school day; and requiring the DOE to fund an additional 1,840 compensatory hours of specialized behavioral and educational services from an independent provider to make up for the time in which the DOE failed to provide an appropriate educational program.
