The FDA and FTC issued joint warning letters to two companies for selling fraudulent COVID-19-related products. The companies, Honey Colony LLC and Dr. Dhole’s Sushanti Homeopathy Clinic, misleadingly claimed that their products were safe and/or effective at treating and preventing COVID-19. The companies were advertising the products at issue – Honey Colony’s “Quicksilver Liposomal Vitamin C w/ Liposomal,” “Jigsaw Magnesium With SRT,” and products with “Silver Excelsior Serum,” and Dr. Dhole’s homeopathic “Genus Epidemicus” medicines and treatments – on their websites and social media accounts.
Separately, the FTC also issued 45 warning letters to stop marketers from making unsubstantiated claims that their products and therapies can treat or prevent COVID-19. The letters targeted companies selling products and treatments such as: Chinese herbal medications; music, IV, ozone, chiropractic, and Vitamin C therapy; homeopathic treatments; air purifiers and water filters; and shields claiming to boost the immune system by protecting the wearer from electromagnetic fields.
The FTC warning letters advised recipients to immediately cease making the unsubstantiated claims, and the joint warning letters additionally advised recipients to stop selling the unapproved and unauthorized COVID-19-related products. The companies were also required to respond to the relevant agency or agencies within 48 hours outlining the steps taken to address the concerns raised in the letters. Lastly, the letters noted that failure to comply could result in legal action, including seizure and injunction.
