• Michelle Ben-David represents individuals and entities in regulatory enforcement actions, criminal trials and internal investigations involving the U.S. Department of Justice, the Securities and Exchange Commission, the Federal Reserve Board, and the Office of the Comptroller of the Currency, among others. Michelle’s work also extends to international clients under investigation by U.S. authorities.

    Michelle was a member of two separate trial teams defending high-profile clients charged with insider trading in the Southern District of New York. She was also a member of the team that successfully represented a client accused of participating in one of the largest tax fraud cases in history. All charges were ultimately dismissed under the terms of a deferred prosecution agreement. More recently, Michelle was on the trial team representing a high-profile client charged with accounting fraud in the Southern District of Florida.

    In her civil practice, Michelle has helped successfully defend companies accused of false advertising in federal court and before the National Advertising Division. She was also a member of the trial team that represented Johnson & Johnson in its litigation with Guidant Corp. in the Southern District of New York. Shortly after closing arguments, Guidant’s parent company, Boston Scientific Corp., agreed to pay Johnson & Johnson $600 million to settle the case before the court issued its opinion.

    Michelle maintains an active pro bono practice and helps administer the firm’s asylum program. In addition to representing clients in immigration proceedings, her work touches on various aspects of criminal legal reform. Most recently, she co-counseled with the Federal Defenders of New York to obtain dismissal of all charges against a client under indictment, assisted a Criminal Justice Act panelist in preparing a client’s sentencing hearing, and obtained vacatur of a client’s felony conviction under New York Criminal Procedure Law § 440.10.
