• Mark A. Baghdassarian advises and represents clients in complex patent, trademark, trade secret, and other commercial cases in courts across the country. Mark’s approach to communicating with judges and juries focuses on storytelling and translating the complex into simple and easy-to-understand concepts across a broad spectrum of technologies, including satellite radio devices and services, connected vehicle technology, in-vehicle navigation systems, consumer electronics, cellular systems, digital imaging technology, semiconductor fabrication, medical devices and pharmaceuticals.

    • Representing Sirius XM Radio Inc. in a patent infringement lawsuit brought by Fraunhofer-Gesellschaft zur Förderung der Angewandten Forschung e.V., a Germany-based research organization, involving licensing and sublicensing of satellite communication networks. 

    • Represented Sirius XM Radio Inc. against a right of publicity claims by a former on-air personality based on alleged use of excerpts of his appearances from archival episodes of “The Howard Stern Show” in online and on-air advertisements, securing a dismissal of the claims as preempted by the Copyright Act and successfully defending that dismissal on appeal to the Second Circuit. 

    • Represented Sirius XM in dismissing a consumer class action claim over advertisement in New Jersey State Court.

    • Represented Sirius XM against a multi-party patent infringement suit brought by Dragon Intellectual Property LLC, securing dismissal of the suit based on a claim construction ruling. The dismissal later included an award of attorneys’ fees and costs. 

    • Represented Sirius XM in a petition for an inter partes review of a Dragon Intellectual Property LLC patent for audiovisual recording and playback technology before the PTAB, securing a decision that all asserted claims of the patent were unpatentable and affirmed by the Federal Circuit.

    • Represented Sirius XM in dismissing patent infringement claim relating to live chat customer service technology.

    • Represented Sirius XM in dismissing patent infringement claims relating to in-vehicle infotainment systems.

    • Represented Sirius XM in dismissing patent infringement action relating to microprocessor design and flash memory chips.

    • Represented Sirius XM in dismissing patent infringement action involving encryption technology.

    • Represented Sirius XM in dismissing patent infringement action relating to audio content that can be downloaded and presented to the user as part of a playlist.

    • Represented Sirius XM, Honda, Toyota, and Radio Shack in dismissing a patent infringement action involving interoperable satellite radio receivers.  

    • Represented XM Satellite Radio in dismissing a multi-district patent litigation involving computer telephony technology. 

    • Represented Sirius XM Radio Inc. in its acquisition of Agero Connected Vehicle Telematics Services.

    • Represented Deluxe Digital Studios, a leading company in the business of traditional and digital cinema services, in a patent infringement lawsuit brought by various film studios.

    • Represented Sinosteel Corp., Sinosteel Trading Co. and Liaoning Jiayi Metals & Minerals Co. Ltd. in a class action antitrust lawsuit alleging price fixing for magnesite.

    • Represented Camtek, a manufacturer of semiconductor wafer inspection systems in patent infringement action.

    • Represented AVG Technologies in a patent infringement action brought by Uniloc involving software authentication.

    • Represented Savient Pharmaceuticals against a breach of contract claim regarding ownership of patents.

    • Represented StarTech Corp., a major innovator of plasma arc technology used for waste management, against a patent infringement action.

    • Represented Prism Technologies in a patent infringement action involving computer software resulting in favorable jury verdict.

    • Represented Advanced Technology Materials Inc., a major supplier of gas storage and distribution systems used in semiconductor fabrication, against a patent infringement action.

    • Represented VICI Properties, an S&P 500® experiential real estate investment trust that owns one of the largest portfolios of market-leading gaming, hospitality and entertainment destinations, including Caesars Palace Las Vegas, MGM Grand and the Venetian Resort Las Vegas, in connection with intellectual property issues relating to various acquisitions.
