Represented Sirius XM Radio Inc. against a right of publicity claims by a former on-air personality based on alleged use of excerpts of his appearances from archival episodes of “The Howard Stern Show” in online and on-air advertisements, securing a dismissal of the claims as preempted by the Copyright Act and successfully defending that dismissal on appeal to the Second Circuit.
