Kramer Levin obtained a favorable settlement for Finjan Inc., when Proofpoint agreed to pay for a license agreement of Finjan’s global patent portfolio. Finjan sued Proofpoint in December 2013 in the U.S. District Court for the Northern District of California, seeking an injunction and claiming that Proofpoint was infringing on eight of its patents with its computer security products. The parties settled after the Patent Trial and Appeal Board of the U.S. Patent and Trademark Office rejected Proofpoint’s challenges to three of Finjan’s patents, all of which were at issue in the Proofpoint case. The settlement was reported in Law360.
