Kramer Levin defeated two petitions by Sophos Inc. requesting inter partes review of important patents held by firm client Finjan Inc. Sophos had petitioned the U.S. Patent and Trademark Office as a defense tactic in response to two patent infringement suits that Finjan filed against the company in federal district court in the Northern District of California. By denying Sophos’ petitions for inter partes review, the Patent Trial and Appeal Board cleared the way for Finjan to pursue its patent infringement actions. The patents at issue are Finjan’s ’926 and ‘494 patents, which relate to systems and methods to protect personal computers and other network accessible devices from malicious software.
