On Feb. 13, 2018, Kramer Levin’s Business Immigration group will present a seminar titled “49 Ways Business Immigration Has Changed Under Trump” at the firm’s New York office.
The program will include discussions on the following topics:
- The end of TN economists holding positions other than strictly as an economist (e.g., financial analysts)
- Mandatory USCIS interviews, arbitrary visa refusals, the end of deference to prior adjudications, and increased H and L audits
- H-1B problems (scrutiny of prevailing wage levels, challenges to traditionally recognized specialty occupations, proposals to terminate AC21 seventh-year H-1B extensions, discussions to implement a preregistration system for H-1B lottery filings, objections to alternative wage surveys and major salary increases for H-1B dependent employers)
- New, more onerous standards for L-1A managers and harsh interpretations for who qualifies for the L-1B specialized knowledge category
- The proposed termination of spousal EADs for H-4s, the coming end of J-1 trainees and proposals to limit optional practical training
- Advance parole processing slowdown and denials following travel abroad
