• Kenneth Mueller, Ph.D., brings deep scientific knowledge and a trial-tested understanding of litigation strategy, tactics and procedure to his work on behalf of clients. A neuroscientist-turned-lawyer, Ken advises and represents clients in complex patent litigation related to a wide array of complex technologies, including small molecule pharmaceuticals, methods of treatment, medical devices and software. He also counsels companies on patents and patent portfolios, freedom-to-operate opinions and pre-litigation strategy.

    Ken has litigated in numerous district courts in declaratory judgment actions and Hatch-Waxman proceedings, as well as in front of the U.S. Patent and Trademark Office in inter partes review actions. His work spans all stages of litigation, from developing an initial theory of a case to fact and expert discovery, summary judgment motions, and trial.

    Prior to becoming a lawyer, Ken held a number of neuroscience research and teaching positions, both in the United States and abroad, and he holds 14 patents. Ken worked as a scientific advisor for intellectual property litigation at a Boston-based global law firm while attending law school. He joins Kramer Levin after practicing patent law at both a nationally recognized biotech- and pharma-focused IP boutique firm and Global 200 firms.

    Ken also has undertaken a wide range of pro bono work, including assisting immigrants seeking to become naturalized U.S. citizens, advocating for immigrant children subject to legal proceedings, defending an inmate’s constitutional right to proper medical attention and defending a convicted inmate against the death penalty.
