• Jennifer S. Windom is an experienced litigator who handles complex civil litigation, securities and shareholder litigation, government investigations and enforcement actions. Her clients include publicly traded companies, major financial institutions, accounting firms, hedge funds, individuals and trade associations. Jennifer often represents clients in the highly regulated areas of health care, government contracting, public accounting and banking, often leading matters that present parallel civil, criminal and regulatory risks.

    Jennifer has successfully litigated high profile disputes in federal and state courts across the country.  She also represents clients in enforcement actions and investigations before the Civil and Criminal Divisions of the Department of Justice (DOJ), the Securities and Exchange Commission (SEC), the Public Company Accounting Oversight Board (PCAOB), and various other government agencies and congressional committees.

    Jennifer has successfully represented several publicly-traded health care companies in litigation and in DOJ and Department of Health and Human Services (HHS) investigations concerning billing practices, physician arrangements and other payment issues. She also has successfully represented major accounting firms and individual auditors in all stages of SEC and PCAOB investigations and enforcement actions. Jennifer has significant experience coordinating with foreign counsel litigating actions abroad and initiating actions in U.S. courts to obtain discovery for use in foreign actions.

    Jennifer previously worked at a market-leading global law firm. Before law school, she worked for a major consulting firm, designing and developing information systems for the country’s largest telecommunications companies.

    • Defending former CFO of Silicon Valley Bank in putative securities class action and related federal and state court litigation seeking billions of dollars in damages.

    • Defending venture capital firm in putative RICO class action relating to firm’s investment in online gaming company.

    • Defending hospital network in False Claims Action litigation relating to alleged overpayments in connection with federally-funded program for veteran healthcare.

    • Assisting leading managing general agent in investigating claims made under transactional risk insurance policies issued in connection with large M&A transactions, including in the energy, technology, and security sectors.

    • Representing elected public official in defamation case against high-profile political figure relating to false claims about election administration.

    • Successfully defended the senior leadership of a large consulting firm against RICO and fraud claims brought by market competitor in federal court.

    • Successfully defended a publicly-traded gaming and entertainment company against $12 billion breach-of-contract claims brought by former partner relating to company’s entry into foreign gaming market. Achieved full dismissal of all claims in both domestic and foreign jurisdictions.

    • Successfully defended a publicly-traded health care management company in civil fraud litigation brought by a major commercial payer. The case was voluntarily dismissed after summary judgment and Daubert briefing.

    • Represented a major defense contractor in a successful bid protest at the agency level and successfully defended an appeal in federal court.

    • Represented a Fortune 500 health care company in consolidated federal qui tam multidistrict litigation and related government investigations involving allegations under the False Claims Act, Anti-Kickback Statute, Stark law and similar state statutes.

    • Represented a publicly-traded online travel company in a federal trial concerning tax treatment of pre-initial public offering (IPO) stock awards to company founders.

    • Represented an energy trade association in litigation in the DC Circuit concerning an Environmental Protection Agency (EPA) rulemaking regulating carbon emissions.

    • Defended major financial institutions in multiple lawsuits and pre-litigation negotiations relating to commercial mortgage loan securitizations.

    • Represented publicly-traded health care companies in various DOJ and HHS Office of the Inspector General (OIG) investigations concerning billing practices, physician arrangements and other payment issues. In every instance, the government declined to pursue charges or seek penalties of any kind.

    • Represented a high-profile political figure in connection with a DOJ bank fraud investigation. No charges were brought.

    • Represented the Audit Committee of a Fortune 250 multinational corporation in a government investigation into potential violations of the Foreign Corrupt Practices Act. No charges were brought.

    • Represented senior automotive executives in connection with separate DOJ, SEC and National Highway Traffic Safety Administration investigations relating to the safety and reporting practices of their employers. No charges were brought.

    • Represented a bank employee in connection with DOJ, Department of the Treasury, Financial Crimes Enforcement Network (FinCEN) and state investigations into the bank’s anti-money laundering and compliance practices. No charges were brought.

    • Represented a senior executive in an investigation relating to alleged unapproved testing and marketing by a medical device manufacturer under the Federal Food, Drug, and Cosmetic Act.

    • Represented a major defense contractor in multiple internal investigations evaluating potential fraud and retaliation claims under the False Claims Act.

    • Represented pro bono a university student facing multiple felony charges relating to constitutionally protected protest activity, resulting in the government’s post-indictment dismissal of all charges.

    • Represented several major accounting firms and individual auditors in all stages of SEC and PCAOB investigations and enforcement actions.

    • Led negotiations with the House Committee on Oversight and Reform on behalf of a major accounting firm in connection with a congressional investigation into a federally funded program.

    • Defended AmLaw 250 law firm against professional malpractice and related claims brought by former client, achieving favorable, confidential pre-litigation settlement.

    • Represented directors of large technology company in confidential arbitration proceeding initiated by employee, securing dismissal of all defendants on motion to dismiss.
